What is the procedure for getting a divorce from an unseccessful arranged marriage which happened in india only after 3 months of marriage.
PS....husband lives in india & he has not gotten his visa to come to country of my residence.

The grounds of divorce under Dissolution of Muslim Marriage Act are :
1. wheabouts of husband unkown for 4 years
2. husband failed to give maintenance for 2 years.
3. husband sentence to imprisonment for 7 years.
4. husband fails to perform marital obligations for 3 years.
5. husband is impotent.
6. husband is insane, has leprosy, or venereal disease.
7. khayar ul bulugh.
8. cruelty.
9. forces wife into prostitution. etc.
It may be easier to convince your husband to divorce you. If he has harassed you in any way you can send him to jail by filing complaint with police u/s 498-A for cruelty or harassment. You can file for maintenance under Sec. 125 cr.pc if you are still married to him. All this may convince your husband to utter "Talaq" under Talaq ul Biddat or triple talaq which is irrevocable divorce.

first of all it has to be seen where the marriage hs taken place and from where ur are seeking for a divorce. As per the muslim law in india there are are some limited grounds on which a muslim wife can seek divorce from his husband The grounds of divorce under Dissolution of Muslim Marriage Act are :

You need to find out about visa status, first.
So you need two lawyers, one for visa and the other for a divorce. Unless you get a lawyer that is well worse in both the speciality.
