contact a probate attorney in the county of his residence.

if there is no equity in the house going to probate will probably cost more than it is worth.

just dont do anything. seriously. all of the debtors are unsecured other than the house.

no equity so the mortage co takes it back and it sells , no biggie.

donate his belongings to good will.

the insurance has nothing to do with probate and you do not owe it to the creditors.

remember, the creditors hae their own insurance to protect them on these losses, so dont worry about them.

Here is another good reason for everyone having a will, even if only to name an executor. I would start by contacting the court that handles things like this. It is called Probate Court here in New York. They are the ones who will have all the answers and experience in this field.

If he didn't have a will his estate may need to go through probate. It will be expensive. The court will assign an executor maybe his mother. If he had a will it would be easier.
Sorry for your family's loss.

I'm very sorry for your loss. Attornies are listed in the phone books and a lot of them advertise free consultations. Call one and he should be able to help you or at least lead you in the right direction. Good luck to you both.
