Is It Possible That Her Former Partner Can Sue Us For Adultery? BTW she has three kids, 14, 12, 5.

You can't sue for adultry. you can sue for breaking up a happy home, but about it. just send her over once a year for his birthday, and call it good.

you can't sue if you two didn't try to get married. Then it's not adultery, it's bigamy. being married to two people at the same time.
you both need to get this looked after.
Not legally separated will end up costing her... both from a legal and financial perspective.
This is not a smart situation.

He could sue her for divorce and claim adultery as the reason, but every situation is very different and I would say she needs to consult an attorney about the particulars of her case.

If she's not legally separated she is still married...so you have put yourself in the place of being a WHORE. Her former partner CAN sue her for residential/permanent custody of the kids, and have a good chance at getting it...that will put the burder of HER having to pay child support to her partner (not former because there is no divorce) If her former partner is smart he will file for divorce based upon the charge of abandoment and file for custody/child support based upon them as well.

No, he can't sue. Here's a better question: Why would you continue to be with her if she's not willing to end her relationship with her ex? She can't say it's for the kids because she'd actually be getting money from him to take care of them, plus he'd still have to provide health insurance, etc.

If everyone went to jail or court for adultry the courts & jails would be swamped & it would take years to resolve them all. You don't hear about people going to court or being sued for that anymore I wouldn't worry about it.

in the states, adultery isn't a reason for a divorce.
