as the spouse (if common law is recognized in your state), you are responsible... you have first rights of burial... if you cannot afford it, you can pass it off to next of kin ... if no one can afford anything they state will bury the body, but there will be no viewing, no funeral service and typically they are cremated and you will have no say where the remains are put after treatment

You are the most responsible for arrangements, however, they don't have to be big and flashy. Most cities have at least one low-cost no-frills funeral home. Does it have to be a burial? Cremation can be even lower cost. If you don't make arrangements, depending on where you are, the body could end up in a public grave or crematorium, with no service for anybody to say goodbye. Is there no estate, no life insurance, no social security death benefit? Have you talked to other family members about contributing?

Generally, there is no legal obligation for anyone to pay for a burial. The poor are frequently buried at county expense.

But I hope that the family can come together and raise the funds to say goodbye in an appropriate way.

In the US, most states don't have 'common law' so don't think that is an issue. Someone will find a way to pay, or get basic services like cremation.

If no one comes up with the money the state will pay ,if not there would be bodies all over the place.You have the right to claim the body but no one can make you pay money you do`nt have.I guarantee that there will be a funeral.

If you are in the uk hun go to your local Social Security office they may be able to help or at least advise you, If there is family I would have thought each of you would contribute to laying your partner to rest? I hope you are able to resolve it.

Nobody is really "responsible". You don't have to have a funeral. If you can't afford one, you don't get one.
