So, we just moved out of our old apartment... Granted we owe them money... 2 months behind.. got an eviction notice... attempted to pay it off, and realized we couldnt in a decent fashion.. so decided to move out.
I have every intention of paying back what we owe.. the last month rent deposit will come off the amount owed.

Because we were given an eviction notice, rather than moving out on our own, we did not repaint the kitchen.
We had to leave a deep freezer in the apartment, because my husband did not have any help to take it out.
We had a court date for Sept 17 for the "eviction hearing" I wasnt planning to go to this because we've left.

I found out from the super at the building that she is planning to tack on $1500. to repaint the kitchen and remove the freezer.

The kitchen was painted red, so would require 1 coat of primer then the normal paint...

Can she do this? I thought the court date was only re: eviction or not...

Yes, I would have repainted had I had the time, but $1500 ??? really... It wouldnt cost more than $50. to repaint!!

That, and the place was so poorly maintained during the time we were there I didnt see it as being a big deal.. we were asking for repairs constantly that never got done.. thats part of why we decided to leave and get caught up after the fact!

Of course. The apartment needs to be in the same condition sans normal wear and tear. If the kitchen needs repainting because of you, you will be required to pay for the work. You basically admit to it in that you would have repainted it if you had the time.

The $50 you quote would barely cover the paint. How many hours do you think it would take? You don't think they are going to fund painters that are going to work for free do you? If you feel it is completely out of line you can ask for a breakdown of the costs.
