The attorney (The best D.U.I. Lwyr in Town) as he was introduced to me by business acquaintance. Gave him my whole schpeel as follows: Met in 11-2001. Talked her into buying a house in 3-2002. Neither one cared for marriage, but she was having Green Card issues. Hell, I loved her, why not? We split all the bills in half the whole time. Married 4-2002. Maybe at the end of 2004 I moved out (been bad for about 7-8 months) into a condo. The whole time split up, still went to I.N.S. Interviews with her, for her Grn Card, cause Im too nice. Pd 189k for house, 2 years later, apprsd. at 365k though she wouldnt buy me out, in fear of me divorcing, and term her Grn Card process. Come to find out around 10-2006 drove by my (our) house to see a 4-sale sign??Told she was denied for G.C., in turn, denied for further Work Permits. Lost job, selling house (her name on title only) attempting to flee back 2 Asia with my half of equity. Hired lwyr to stop actions ASAP against sale of the house.

Do I have a case against my lawyer for negligence? I think the house was foreclosed on and the money might be gone too?

Name not on deed, NV is state. Communtity property here. She only had the house 1 month before we were married. She is nowhere to be found. Also her passport has stipulation that if she leaves country, she cannot return. Lawyer did nothing to stop any actions with the house, instead was trying to locate to serve for divorce for 10 months???

No. It's not his job to set up watch on her house.

Community property does not normally apply to deeded or titled property. If only her name was on the deed, you are probably pretty much screwed.

If your name was on the deed she could not sell the house without your consent. Whether it is foreclosed you should call the mortgage company or hire someone to do a title search, you may be able to do that yourself on line, I think you need to find out the status first. Maybe contact immigration. If house is not foreclosure but may may be Bankruptcy is what you need to do or buy her out she sounds desperate give her $to sign over deed. Even if you could find a lawyer to take your case it would cost you .a lot of money to file a malpractice action

How would your attorney be liable for negligence? Sounds to me like the only person who messed up was you.
