if you're the custodial parent, then no. you have assumed financial responsibility for the child, while he is obligated in a court of law to provide child support for that child. however, if he is unemployed, you don't have much legal leverage against him in terms of making him pay. the court would probably grant some leniency, at least for a while, till he gets a job. you probably won't get as much right off the bat, but if he still doesn't hold a job, the court will impose stricter penalties. either way, since you have custody, you're not going to have to pay him anything.

That depends on state laws. If he is unemployed or underemployed in order to avoid child support, then no. He is still responsible. If he in living in an area where the economy is so bad that there is no work, then he might have a viable argument. Get a lawyer. That is the only way to know for certain.

This is how it works in California. The custodial parent files for child support with the state. They send a check to you and collect or garnish the wages of the other adult. If he cannot afford to live on his wage after garnishment, he, has to file with the social services to get a reduction based on a percentage of his present income. If at any time he does get gainfully employed it is up to him to notify the proper agency. This takes the burden off of you to get money for your child.

i doubt a judge would reduce the amount of child support if he only works partime but is capable of working full time... my x was told by the judge to get a second job if he was having trouble making the payments....

He might be able to get current payments lowered but he still has to continue to pay what he is behind in full.

are you really feeling sorry for this guy?
i mean its ok when hes going thru a hard time but common its ur kids ur talking about they need their things now, and even though u have a full time job nad he dosent it shoulndt interfere with those child support payments.

it depends on who has the child not who works. if the kid is staying with you then no he does not.
