An agent who used to let out my property is letting out my property without my consent and is not giving me the possession of my property. And he takes all the money from the tenants and gives me nothing. He threatens me at times and tell me to do whatever I want to do.
I have served the occupiers a notice under section 21(1)(b) and 21(4)(a) making sure any tenancy agreement they may have done with the agent comes to an end. Did I do the right thing? Now I am waiting for the date to get over so I can get a CCJ and bailiff and get the occupiers out of my property? This is the right procedure or what can be done? I cant afford a lawyer. Please help. Thanks

I dont know much about him. He wont show me any proof or any tenancy agreement not even the tinest details. He tells me to talk to the tenants and the tenants say to talk to the agent. I cant seem to get any info from anywhere.

That is a good first step to get the tenants out. As soon as they are out, I would take the practical step of having a locksmith (and a sheriff's deputy or other law enforcement agent) go to the unit and change the locks.

Next I would go to the police and find out the process for getting a cease and desist order against the realtor.

Finally, not sure what the figure would be, but I would sue the agent in small claims for the rents he took and any incidental fees (i.e., the locksmith, etc.).

I think we need some more details here. Is the agent giving you a reason for their behavior? If the agent is a licenced Realtor, they are governed under rules of that body. Check your local Realty Board.
