My landlord is requiring each apartment in our building to completely clear off our porches/patios for cleaning and staining. We were given less than 24 hours notice. I have no place to store a fair amount of furniture and flowers. We were told that the porches should be cleared for 3-4 weeks. Is it reasonable to expect the landlord to refund a portion of rent and/or provide storage?

It depends on your lease. I work at an apartment complex and we give our residents 24 hour notice as a courtesy. The lease states we are only required to give 12. Regardless, it is unnecessary to not let you use your patio for 3-4 weeks.

I don't think your landlord is required to even give you 24 hour's notice (or any notice at all, for that matter) for making repairs to an outside access area (if he were to enter your dwelling, that would be a different story, depending on the situation).

In addition to that, as sucky as this is for you (I'm a plant lover, too, and wondered what I'd do with all MY stuff if my landlord ever wanted to do the same to my balcony), the landlord wouldn't be required to provide storage for anything you have out there since it is not making your life uninhabitable or unsafe.

Do you have large windows or a sliding glass door? See if you can find an old card table or some other type of shelf (baker's rack, bookshelf, etc.) to put your plants on while the work is being done...besides; it'll give you the excuse to dig in the dirt and repot some things and tend to your plants. ;)

Well first off let me tell you that your landlord MUST give you 24 hours notice to enter or make repairs on his/her property, unless it is an extreme emergency. However, your landlord is not liable to deduct rent or provide storage space for your fair amount of furniture that needs to be moved.

It is advisable that you tell your landlord that you are to have 24 hours notice and you will move your items within that reasonable time.

Unfortunately not, They gave a 24/hr notice for renovations. if it were to go to court the judge would see that in reality it is only benefiting you in the long run. I know the storage issue is a *****, but at least they aren't saying you cant put that stuff in the house....

Mine did the same thing to us! We just cleared as much as we could! but they just worked around it! if they say anything.. Tell them straight up! YOU DID NOT EVEN GET US A 24 hour notice!

great q, technically, if it is not for emergency purposes, you MAY have a good point, since they ask for 3-4 weeks. but they may INSIST that whatever they need the staining and cleaniing for , it serves a SAFETY purpose and therefore you MAY not have a good enough case. good luck.
