then does he have any legal rights? I have heard he would have to petition it get a paturnity test taken and I would have to consent to it. And if I do not then nothing happens. Does anyone know anything about this kind of thing? Thanks in advance! :)

Okay, since your baby's daddy is not on the b/c and wants to have rights to the child then yeah he can file for a petition to child modifications, meaning yeah he would have to file for a paternity test and that would come out of his pocket not yours. Now though, do know that as a mother it will work more in your favor than his. He will pro'lly owe a lot of back-pay once the test turns out to be his and once he gets caught up with that then he'll have his checks garnished till the child is 18 years of age or decides to go to college. But as of now, since he hasn't filed for a petition he has no rights. But do know once you do go to Court, then he will have the child every other weekend and every other holiday as well as a full month in the summer....i hope that helps you some...

Whether you like it or not, knowing both parents is your child's right. If there is doubt about paternity, the father would have to petition the court for a test.

If you know he is the father, but he is not paying child support, visiting or doing other positive things to benefit the child, then you should negotiate these rights and duties. If you need help, bring in a counselor, minister, family services, or the court to help reach an agreement.

The court can ORDER a paternity test if it is requested by either party. The court will not allow you to unlawfully terminate a persons parental rights simply by non action.

If this man is the father, you are doing a HUGE dis-service to your child by interfering with their time together.

Be a grown up and deal with it.

I believe that if you refuse to allow the test on the child that he is automatically assumed to be the father. If he is the father and it sounds like you know it, then he must be unfit if you are trying to play that card so I would use that to fight you're battle. Don't refuse tests or information, it makes you the bad guy.

The real kick is if he doesn't want the child then you can still persue him for childsupport whereas if you didn't want the child you could simply have killed it via abortion regardless of what the father wanted.
