My sisters marriage is for all practical purposes over. Her husband has fallen for another woman, but even though my sister has asked him to leave he won't. There are two children, so she's gonna stay in the house so the kids can still have some stability.
What's the solution?

Put his things out in the yard and change the locks . she must file an eviction with the courts and then she can legally change the locks . good luck .

First, it is crazy to think those kids are going to be any better with them under the same roof and one is DATING! Has she ask the children what they want? How they feel ? What are the thoughts going on in their minds?

If it's over than take it to the end, and do the divorce! Stop pretending! Those kids aren't stupid, but if the parents continue in this manner the kids are going to think that their parents have NO merit and they WILL LOOSE RESPECT for them!

Stability comes from making the hard decisions coming to an agreement of time share and STICKING TO IT, of course get in writing!

Get and mediator involved, NOT a family member! Someone with NO involvement either way. If necessary take him to court, depending on how it is for the children. The court may have to make the necessary decision, if I was him I would do all that I could NOT to get the court involved! Maybe it will take her to JUST get the lawyers involved.

The children have my prayers!

How awful for her and the kids!! She needs to file for divorce and make sure she gets the house. If they are still married, even if the relationship is over, the property is still jointly owned and he has a right to live there.

She may be able to ask for a legal separation while the divorce is pending and see if she can have him take up another residence.

Depends on if they own or rent the house, and who's name its in..or if its in both. If he doesnt want to leave though, maybe she should? Friends and family maybe can help her out with a place to stay for awhile. Just make sure she takes her kids.

he probably isn't leaving because the other woman has not yet made a commitment and he is not sure of her, but as soon as she does he will be out most likely. your sister should not have to live like this, she needs to file for divorce, he may not be leaving because there is no place to go yet.

She needs to get a lawyer and take him to court. If she can prove that he is having an affair, it will help her out in court.

WHy won't he leave? If there is a good reason, then maybe they should talk about it. If there is not a good reason then she should file for a restraining order.
