There is no such thing as common law marriage in California. There is marriage. There is domestic partnership. There are contracts.

That's all there is.

Common law does not exist in the state of California. This is a common misconception. If you want to get something from someone you're living with, they have to make you a beneficiary or make you an emergency contact on their medical information. Other than that, you're screwed without that marriage license.

There is NO common law marriage in CA. None. There is not. You either marry someone officially or you're not married. Some states used to have a thing where if you lived together for 7 years or whatever, you were considered married, but that is NOT the case in CA. If you don't have a marriage license and certificate, you're not married, and don't pretend you are, because in the end, it won't count. You won't have any succession rights or support rights or property rights. If you think you're married just because you've been with someone for a long time, you're wrong.
