In a verbal agreement with my mother and the landlord. I took over rent in our house. I was never presented with a lease or a contract of any kind. There is no verbal or written. Set date to when the rent is due. I usually pay it around the 10-12th and he seems to have no problem with it. Never says anything to me about it. Anyway this month is tight and I wont be able to make rent until the 14th. Ill have the money that afternoon. Is that too late you think? He has never said i want the rent on the first or before the 20th or anything like that. No specific date.

Out of courtesy you should talk to him. A verbal agreement is also called a "gentleman's agreement." The unspoken rule is that gentleman treat each other amicably and with respect and courtesy.

You could just let him sit and wonder and without a written lease there isnt' much he can do about it. But there will come a day when you need him for something (maybe getting a plumbing problem fixed) and that will be when he's in no hurry to tend to your issues.

Since it was a verbal agreement, he is probably following the same written agreement he had with your mother. Call him and let him know. Just for his (and your) clarification, you might also ask him when the rent is actually due. There might be issues in the future that may preclude you from paying on time. Take a look at the agreement he signed with your mother. There might be some answers there.

I think since there is no written lease agreement the landlord cant enforce any type of late fee and they would be required to spend money to start the eviction process. My answer is no until he notifies you on which date he would like rent go for it. But I can tell you this, if there is a mortgage on the property they will be late after the 15th so they will in fact be required to pay a late fee.

He'll be cool with it, he has to- as you said, theres no written agreement so he has now way of forcing you to pay the cash should he turf you out, and if you've been reliable in the past he'll wait rather than go through the agro of getting someone else in. If he's a reasonable bloke he won't think like this anyway and probably won't mind waiting as long as he knows whats going on.

I would check with your mother what the actual due date is on the lease. And you need to have your landlord give you a lease at least showing that you have sublet from your mother. When you move, if you don't have proof of your lease your landlord could say that you didn't have a lease and didn't legally live there.

You DO have a verbal agreement! In absense of an agreed rent due date, it is presumed to be due on whatever day of the month you moved in and took over the tenancy.

you cannot be charged late fees since there never were an establish due date or lease to say that you need to pay on a certain date. I an certain that he is not worried about the rent. the land lord is probably going on your moms record.

do you mail the rent, take it to him, or he comes and gets it? if you take it to him, i wouldn't say anything. if he calls a couple of days before and wonders where it is, just say you've been super busy. and you'll be there in a couple of days!
