What is a computer related crime and what are the state and fedral laws that pertain to the crime?

Any crime that is committed through the use of a computer is "Computer Crime". Offences can include Spamming, Flaming, Data Theft, Hacking, Criminal Damage and Fraud, to name some offences. There are no defined laws for most offences as the criminal will be charged with existing legislation. If you obtain goods over the Internet, with a dodgy credit card, you will be charged with Fraud and / or Obtaining Goods by Deception. I'm not sure about the US but in the UK, most offences can be prosected under the Telecommunications Acts. These include the "Misuse of Telecommunications Equipment Act. Basically, if you swear, slander, libel or use an Internet connection for any criminal activity and / or Spamming, Hacking etc. you are breaking the "Misuse of Telecommunications Acts" For minor offences, it's likely that you won't be convicted but BT will disconnect your line and you will never be able to get a phone line again. Therefore, you will permanently lose your Internet connections as well. To find your answer, you need to specify a particular crime then find the penalty as committing a crime through the use of a computer is not an offence. It's the actual crime that's an offence.

That is an interesting question. There is no broad definition of the term in the law, but it encompasses any crime in which a computer is a "necessary instrument."

The use of a computer to reach across state lines can invoke federal jurisdiction and/or enhance the sentence. The reason being is the crime actually takes place at more than one location. It takes place in the jurisdiction(s) where the offending material was sent, and it also takes place in the jurisdiction(s) where the offending material originated. Thus, there are multiple venues for prosecution, and each jurisdiction is entitled to prosecute the perpertrator on a separate count. (e.g. If I sent the same illegal pornography into two separate states using the same e-mail, I could be charged with two counts of the illegal distribution of pornography and the sentence could be enhanced on each count because I used a computer, or the use of the computer could constitute a separate charge).

Further, the laws of different states can differ significantly, but if one sends material from a state where said material is legal into a jurisdiction where said material is illegal, then the sender can be charged in the jurisdiction where the material was sent even though the material was not illegal and no crime took place until it was opened in the jurisdiction where it is prohibitted.
