I didnt file my taxes for 2004, so when I had my taxes done in 2006, I asked them(Liberty Tax Service) to do my 04 & 05 taxes. Now I got a warrant from NYS and they want a copy of 2004's tax return. I contacted the tax preparer and told them I need a copy of my NYS return for 04. They looked for it and told me I didnt file NYS in 04! WTF I payed this preparer to do my taxes for 04 and 05. I have never done my own taxes and do not recall telling them not to file my NYS taxes, why would i do that? So, now NY wants a copy of this return and my preparer says that they didnt do one for 04. What the hell? Why they didn't do it is beyond me. Can I hold them responsable somehow? Dont they have to have something in writing that says i dont want to file for NYS tax?

If NY is like most states, you can take a copy of your federal return and transfer most of the numbers to the state form. Give it a try. You should be able to get state tax forms on line.

Sorry, but YOU are responsible for the preparation and filing of your return. If they didn't prepare one, YOU had to know that fact as you never received a copy from them or signed the copies to be filed (or the paperwork for e-filing).

WTF is YOU aren't on top of YOUR finances. You have ONLY yourself to blame for that.

Do you have any type of receipt or paperwork stating they did the '04 taxes for you? You should keep copies of that type of paperwork for up to ten years.

Unfortunately for you it is YOUR responsibility to ensure your tax returns are filed. You may be able to get them to FILE it for you for free, BUT the taxes due and penalties etc are your problem..
