Actually, a court hasn't made that decision... a prosecutor suggested that Scientology be put on trial, but no charges have been filed.

I will be happy when Scientology IS formally charged. I'll be even happier if Belgium can make it stick (Scientology has a knack for wriggling itself out of trouble). Scientology certainly IS a criminal enterprise and a real danger.
