Do you own/operate the daycare? Did you have specific rules regarding such behavior between employee and parent when the employee started working at the daycare? Did you talk to your lawyer regarding restricting such behavior and the ramifications of such restrictions?

Unless you can answer yes to these questions, I can honestly say I don't see where you can stop someone from dating an employee or a parent. What they do outside of the work premisis is none of anyone's concern but their own. Unless they bring it on the daycare property, and cause issues with other parents, children, or employees then I see no problem with it.

It is legal to restrict employees from dating one another, although there have been some challenges to this lately. Restricting who an employee can date outside of your company, however, is a very tricky business and would be difficult to justify from a legal standpoint. Labor laws in every state vary pretty widely so it would be best to check with an employment attorney in your state to see if employers are allowed to restrict employee rights in this way.

And realistically, even if you prohibit it, they could do it anyway on the sly and you probably wouldn't know. You may just want to include a statement in yoru employee handbook along the lines of "In order to maintain the professionalism of our day care service, employees are strongly discouraged from forming personal relationships with clients ouside of work." This could be applied to anything from dating to offering babysitting services after hours.

Well, if it is one of it's work rules, then yes it is. So look at your employee handbook. The way that I look at it is that if the two adults break up, then the parent of the child may withdraw the child from day care. Hence, they loose a customer and loose money. It could also damage the day care's reputation. The parent of the child could say something nasty about the employee they were dating and thus damage the reputation of the day care. If you don't do what they say, you may get fired.

When you were hired, you HAD to have been given either a code of conduct or some sheets with rules or what is and ISN'T expected of you while you are an employee of the day care center.... IF DATING CLIENTS PARENTS is not on any of those sheets, then they can't do a THING about it... IF you were hired and THEN they made it a policy----then no, you couldn't date a clients parent.. HOWEVER, if you worked their, started dating a client's parent and THEN they made it an policy, they could NOT stop you from dating the client IF they knew about it PRIOR to them making it a policy that employees cannot date clients parents...... confused?

Its not a legal issue, its a policy issue.

Are you the owner of the day care?

You hire an attorney, to draw up the contract so that when its time for your employees to sign the paperwork you point out the policies and procedures where it states, "no dating the clients."

That way, if it happens, you can fire them.

It should be, conflict of interest. Day care employees should not be using a day care center to pick up people anyway, that person has a screw loose and should not be around children.

Yes, you should make it clear when hired. Some companies don't allow coworkers to date. When someone wants to date someone they can't then they may quit or sneak and be fired.

Why stop them? With any luck they will eventually create more "business" for the daycare center.
