I moved into an off-campus apartment about a month ago and my roommate is making my life a living hell. she is smoking pot in the apartment, has people over at all times, is very loud, she is threatening me and my other roommate. We have talked to management about it and they aren't doing anything about it! How can we get out of our lease. We feel very unsafe living here. we are young serious college students and this is really having an effect on our health and school work. Is there a way we can get out of the lease?

Since this is an off-campus apartment, our first roommate(the one that smokes) was already there before we were. In most off-campus apartments, you have to rent per room.

There is an easy way to handle it:

Tell your roomate, that the next time that she smokes pot in the house, you will not bother asking her to stop, you will simply pick up the phone and call the police. If she is on financial aid, that can put her entire college career in jeapordy.

If you find her stash, flush it down the toilet...what is she going to do? Call the police?

Second, if she gets arrested, you can PROVE that she has broken the law, and the landlord then has a legal right to have her evicted....which means you don't have to move...she does.

However, YOU don't have a legal right to move unless you go to court and have the court break the lease for you.

Remember that petty roommate squabbles, no matter how great, is never a problem of the landlord...I own properties near the college and get these calls all the time...and I'll be honest..I explain to them the importance of picking a good roommate BEFORE they move in...and if they don't like each other, tough...not my problem.

Leasing offers flexibility in terms of the options available. If you wish to change your car every few years or if your lifestyle demands a new car every few years, then leasing is an attractive option. So lease is more beneficial compared to a loan.

She's YOUR roommate - and I assume that you chose her, it's not that your landlord forced her on you. So you wouldn't have any grounds for breaking your lease based on her bad behavior - it's not the landlord's fault, nor the landlord's to fix. If the landlord decided who your roommates would be, then you might have some grounds for expecting him/her to help fix the problem.

A better question would be how can you get this roommate to either shape up or move out. Good luck there.

Take your balls out of your purse and do something. Call the cops when she starts smoking pot etc. Make her life hell. She will come back at you so be ready and don't take her BS. Watch the movie Pacific Heights.
