I would say you have a weak case at best. They say you were fired for performance. You (with out ANY proof) say you were fired for being gay. If your writing is any reflection of your phone etiquette, you were justifiably fired.

Most employment is at-will and they don't have to give you a reason anyway. If your phone etiquette was bad, that's reason enough. If you focus your life on the issue that you are gay, that is annoying to everyone, whether it is an issue or not. I say this because I don't care if someone is gay, but when it becomes their entire identity, that's too much. Think about it for a while. Maybe your phone etiquette had gone downhill. Maybe it's time to move on. When one door closes another opens. It might be the best thing that ever happened to you!

I don't think it's possible, simply because the burden of proof is on you to show that you were discriminated against. If you don't have a better response to their assertion that you have bad phone ettiquette than "please I was a telemarketer forever," you definitely won't win. Just find another job -- I'm sure there are plenty of places to do telemarketing. You might even be able to prove enough to get unemployment, but definitely not to sue them and win.
