A friend of mine had some problems. If/When it goes to court a judge can let the agencies use the accounts to payoff debt. It is a factor in claiming bankrupcy.

They look at it as "If you can afford to save, you can afford your bills"

If you have a problem try to deal directly with the collection agency. They will likely settle the debt for much less.

Generally, social security benefits can't be attached, but other forms of retirement income can.
