I was babysitting for my niece (3 kids)when she abruptly stop bringing them and only so far paid me $60 for 2weeks however she left the kids strollers, toys etc and has failed to retrieve the items after I've called her 3 times. Is this abandoned property? What action should I take now?

You are required to notify her BY Certified (RRR) letter that if she doesn't retrieve the items within a specific timeframe (5 days from receipt of the letter is sufficient) that you will consider her inaction as permission to dispose of the items.

Then, once the time has elapsed, dispose of them.

If you plan on suing her for the monies (allegedly) owed, then keep the items until after the case is heard and decided.

Depends how close you are with your niece I guess.

If you don't have a particularly close relationship then I would probably suggest you call her or leave her a message saying that if she doesn't collect the items she has left at your house by a certain date then you will be disposing of them. (then it is entirely up to you whether you sell them or dump them)

If you are close then maybe you can let her know that you are worried about her, want to know if anything is wrong and why she a) doesn't need you to babysit and b) doesn't want to come to collect her things.

Send her something in writing stating that you are demanding payment or you will sell the items to make up for it. Then sell the items to get the money you're owed.
