In most divorce settlements the question on his retirement will come up and you will be allowed a certain amount based on how many years the two of you have been married.
Personally I don't agree with women when then fight for money on retirement or the mans 401K, I mean he worked all those years for that money for some greedy lady to come along and take 1/2 of it. I know the majority of women will say "well I deserved it" I'm sure you did. But so did he.
Sorry this subject is just touchy for me. I was married to my ex for almost 10 years and I left with three small children. All I asked for was child support. I didn't work those years I stood home taking care of the kids but that was my choice to be with my babies and rasie them myself. I never asked for alimony or any of his 401k even though my lawyer said I should. Sorry just my opinion.

Check with your State Laws. Some states allow you to get a percentage of your ex's retirement, but you have to meet a certain criteria.
