what happens to both employer & the employee?

For their purposes, it's like you never worked. You can get the employer in trouble but it won't help you. It might make you feel better though. But you could get in trouble for not reporting income to the tax people.

Flext, come on now, you worked "under the table", OK, so your boss didn't pay into the state unemployment fund and you didn't pay into the State,Federal, and local tax system( including Social Security . You could end up being taxed on your monetary gains(paycheck) cause "working under the table" and not paying taxes is illegal and the local,state and federal govt.will hit you up for back taxes. Remember that Al Capone was convicted on income tax evasion and sentenced to 10 yrs in Alcatraz. So, if I were you I would not go sign up for "Unemployment"Your former employer can say that he paid you same as a "Contract Employee" ( You quoted a price for the work, he paid you and it was up to you to file your taxes quarterly. Therefore it was YOU who failed to file and all the blame falls on you, not your employer. OK, lets say you "contract" a job ( offer a bid on a job to complete work required such as repair / replaster walls and paint. You "contract out the replaster" part of the job while you do the painting. You pay your contracted plasterer out of your money for doing both jobs and of course collect your share of the job. Now,it isn't your responsibility to withhold earnings taxes on the replaster it is the replaster's respnsibility to pay his own taxes. So , if you are trying to get your employer in trouble I am afraid it will backfire on you instead for failure to file your own taxes
