Is it a violation to be in a car with a driver that is intoxicated(your the passenger) when you had a 1st offense DUI misdemeanor? Or Anything else in general that I can avoid to a violation in the 3-5 years probation. Please feel free to add on anything related to this subject. Thanks

It is highly unlikely that it is a condition of your probation that you not associate with people who are drinking (though it probably is a condition that you stay out of bars and liquor stores). If it could be claimed that you were aiding and abetting the person driving under the influence, then you could have your probation violated for breaking the law by doing so. This is probably not a likely scenario, but it is legally possible. However, whether or not it might be a probation violation, why in the world would you get into a car with a person who is DUI? Your personal safety should be more of a concern than a probation violation.

What you can do is meet with your lawyer. I'm sorry, but without knowing more information nobody can really give you anything resembling an accurate prediction of what will happen. Your BAC levels are going to be a BIG factor in what the prosecutor will offer you. (Despite what Hollywood likes to portray, trials are very rare. Only about 5% of DUI cases will go to trial - and this almost never involves a first time DUI arrestee.) That you blacked out is concerning because, unless you are a light weight, this likely indicates your BAC was really high. Most jurisdictions will have categories of consequences based on what your BAC was. (Meaning that if you are under a .08, you would probably be offered Negligent Driving with Alcohol Involvement; between .08 and perhaps .12 might be deferred prosecution/adjudication, etc.) Your attorney will be able to let you know what you can expect. You are very lucky that your insurance company is taking car of your car.

Don't break any law, ever, while you're on probation. The DUI wolves are very hungry in CA. It's their biggest moneymaker.
