If an image says the following on the TOS....

Am I allowed to make a flyer with the image for my band, hand them out, with no profit to me? I'm not making a profit. Can I use those flyers to have the printing company print them up? Once again, I'm not making a profit...so how does that work?

If u reaaaaaally want to use the image so badly try writing to the owner of the image and obtain written permission to use it... I think you may probably be given some kind of conditional permission to it.

No, you're actually using it for profit to get interest in the band. Non profit use is for personal enjoyment only, or for teaching classes. Anything that exposes it to the public outside of those two things would be a commercial use.

However, if you contact the site and ask if you can have permission to use the picture and tell them what it's intended to be on, chances are good they'll give the ok simply because you were courteous enough to ask. It's worth a shot at least.

I'm not a copyright attorney, but it seems to me that distributing flyers IS a commercial use. You're advertising. I'm guessing that this is not an acceptable use of those photos.

You can always contact the photo owner and ask for written permission to use the photo for your flyers!

If your the one who submitted the image yes you can do whatever you want with it. But if you found the image off a site and are making flyers with it and it is for non-commercial use that can get you into big trouble if someone notices.

Are you going to make any money at all? Is there going to be any money involved at all? If not, then it should be okay for you to use the image. The whole idea behind this "non-commercial use only" is because if it's non-commercial, it means there is no money. No money, no point of suing. :)

You could be legally liable....it's still considered commercial use.
Try taking the picture and make some obvious changes and additions to make it yours. I think you need something like 5 changes to make it "yours".
