Ok... im a lil confused! 8 months ago, my close friend found out she was pregant by a very sucessful guy she happens to be involved with! She really loves him, i would say, the pregnancy pretty much pressured them into marriage quickly! They tied the knot at w/ beautiful, big catholic church wedding. . . but i cant find any records on file of them being in a CIVIL MARRIAGE! no marriage licenses, no record of them being married at all! What are the benefits of a religious marriage without a state marriage licenses? Why would she even agree to such thing? Hes been known to cheat on her since even b4 the marriage, but she would never admit to me that this "marriage" is only beneficial to him and not her. . . Is a religious ceremony wedding a marriage with no strings attached for him? n shes just too blind to see that?

This is only a guess but I doubt a priest would perform a church ceremony without a state-issued marriage license. As far as the license being recorded, many times it takes months for the county recorder's office to catch up with the paper work. If you're worried about what might happen if there's a divorce, sounds like the marriage is going to be found by the courts to be valid, especially after a fancy church wedding.

First,if you didnt obtain a marriage license permit in the first place then you dont have a legally binding marriage now. You can have the marriage in a church or backyard or wherever, but without that permit its not legal. Religious divorces are nolonger legalin this country so you will have to go thru a divorce court to get your divorce provided your marriage is legal to begin with. Without a divorce from the first marriage , any and all marriages after the first one are null and void and thus illegal. So figure out whether your marriage is legal ad binding then decde if you want the divorce and then decide if another marriage is in your future

Someone forgot to get the marriage license. It doesn't matter where you get married, you have to get a marriage license in order for it to be legal. There is no difference between a religious ceremony and a civil ceremony. You have to have a marriage license from the state.

the Catholic church will not marry you if you do not have a state marriage licenses. You do not need to get a civil marriage, if you have a marriage licenses and a church wedding.

If no marriage license has been filed, she isn't married. Check with the minister who performed the wedding. If he left it up to the groom to file the license and if the groom failed file it, I suppose she could file a claim of fraud against the the groom along with a divorcing him as a common law wife (she will need to check with her local government what constitutes common law marriage). Good luck and God bless.

There is no realy benefit at all. If they are not legally married and they have a joint bank account he is free to empty that bank account, if they have a home together he can take everything out of that home, take off and leave her with nothing but the bills and she won't be able to do a damn thing about it since there was no legal marriage. He has it made!

I believe the preacher usually asks to see the marriage license before he marries a couple. I would contact the priest that married them and ask them if there was a marriage license.

If they never got a marriage license, then they're not married in the eyes of the government, which means they can't file joint taxes, and unless they've been together long enough to be common law (usually 5+ years) then a legal divorce wouldn't be necessary (so no alimony) and there is no community property.

that's odd that there is no record of them being married. even if it was a religious ceremony a marriage license should have been filed.
