the bank dont have to honor a post dated check, or wait to run it thru......
they'll put it thru, and charge you, and when you complain...show you the rule, on a piece of paper you signed...
when you opened the acct...........

It is not illegal anywhere that I know of to write a post dated check. However, in most places it also does not work. They can legally cash the check the minute you write it, regardless of what date you put on it. By law writing a check means you have the funds at that time to cover the check in your account.

It is not illegal, and the post-dating is worthless. There is no law about post-dating, the post-date is nothing more than a gentleman's agreement and means nothing to the bank. The person who the check is written to can go immediately to the bank and cash it if the funds are available, and the check writer has no recourse.

technically no. However legally a post dated check is not treated as cash, like a normal check, it is treated as a promissory note, basically an IOU. That is why most businesses don't accept them. Its much harder to collect on a bounced post dated check.

Interesting situation. I know banks will process an individuals check without looking at the date, but not a paycheck. Conflict of interest in my opinion.

Not illegal, but if you're going to do it you need to include a note not to cash it. Most places will just deposit it and then you'll be up a creek. The bank shouldn't honor it, technically, but the previous poster is right. It's legal.
