My brother is attempting to mediate a custody issue involving a woman he was never married to and is being told by the biological mother that he can't see his 1 month old daughter without her present for the first 2 years. We were hoping to mediate this issue without an attorney and can't find this "rule" in any of our research. There would be someone present who could help him with any new baby issues and he is only asking for a few hours while she is so young. Any information would be appreciated, the attorney I called today hasn't called back yet and he is worried sick.
Paternity has not been established but the mother INSIST the child is his and he believes this to be true.
My brother is gainfully employed and has no criminal record that would make his visitation a risk.
The mother is unemployed, has no car and lives with her parents and two other children and has been extremely unstable and threatening to our family.

If you haven't gotten a call back from the Attorney you contacted, your brother should try Legal Aide.
