My husband and I are seperated, well not legally, but not living with each other anymore. I have a job at the local home depot, my daughter goes to school and son at daycare. I am not legally divorced because my ex pays about 350 a month for his son. And if I take him to court, #1 he may fight for custody, #2 I won't get as much child support from him (I already checked the percentage). So my question is, do I qualify for food stamps if I am legally still married? He makes good money, but he doesn't pay for anything for me except the 350. So since I am married, would they still take his income into account, or do I have to be legally divorced or seperated or what? Or do I just have to tell them we live apart. Thanks for your help.

No you do not qualify. You have to be either LEGALLY separated, or divorced.

If you apply for food stamps, they will definitely take his income into account. Either way, it could hurt you. #1: If you tell them that the two of you aren't together, they will take most of his check and you'll probably only get 50-100 dollars a month. Since you'd be getting assistance, your husband will be paying your food stamp bill. #2: If you tell them that you two are still together, his income will disqualify you.
Try to talk him into giving you a little more money a month. You don't want the D.A. in your situation if your husband is paying you support. That will hurt the both of you.

They will not you are still legally married and you can say he lives anywhere but if you are still legally married then they more than likely will take his income into account. Also why would you not just work out custody with him and file for divorce?

In my understanding, it depends on the State in which you apply for assistance. There are some states where there are no formal documents required for a separation. You need to go down to the DHS office and apply for services for you and your children, and tell them the truth.

Also, he should be paying child support of a certain percentage of income. if he isn't, talk about getting help with that too.

Every state is different and the amont of time of different living apart is different. So I would check with my local welfare office online most have charts you can look up so you won't have to make a trip for nothing. Good luck with everyting.

yes u can but your local DES may want u 2 go 2 file again 4 child support n it dosent matter if your still married my ex did that 2 me

if you are legally married, they will probably want to take his income into consideration too...check your local department of social services website, or just call and ask someone. you wont have to give a name

They give assistance to people all the time who are not here legally why not you.
