The same thing happened to me.. I unknowingly claimed my kids after my X had already claimed them. There is no law against this...so I got the correct refund. The IRS went after my X and she had to pay them back.

It depends on if she was court ordered to only claim them every other year then yes-not like they would do anything about it, but you can call the irs and turn her in I would.

Probably. I just had a case like this in MN, and we got a contempt order against the offending spouse.

You can paper file your return, with a letter explaining what happened. Send a copy of the divorce decree. When they take a look, they will make him pay back the amount received.

Possibly. It depends on what your agreement says.

More than that though, they are in violation of federal law because they filed a fraudulent tax return.
