My neighbor has had contractors at her house for the last two months. They have repeatedly parked on my pavement after I have asked them to move their trucks. Now my pavement is coming apart on the spot they had their trucks. I even called the cops once to have them move their truck and to stop all the noise all hours of the night (last week they were using power tools at 3:30 AM. Can I sue them for the damage to my property? And how do I prove it was them?

yes if you have pictures and liecense plate numbers.the police saw it also so they could a help. you could sue for distubance too

Hire a licensed paving contractor to inspect the damage, and give you an opinion as to whether or not a truck of the size you described could cause that damage.

You can sue both the contractors that parked there, and your neighbor who hired them.

Yes you can sue them for damage to your property caused by their trespassing. That doesn't mean you will win, but you sure can sue them. To prove the damage was caused by them you would probably need an expert who knows about pavement and its weight bearing capacity who can determine whether it was broken by the trucks.

Yes. Take photos. Write down the license plate numbers of the trucks.

Take pictures of the trucks on your broken concrete. Video the midnite work. Some cams had time of day.

Shoot videos and pictures, get statements from neighbors and also get the police report that you called and complained.Contact a lawyer for consultation and go from there.

if your neighbor will help you that should be good enough proof, i would definitely file a suit in that case.
