Ok. Here goes.

I moved out of my mobile home back in April. My mom decided to help me out and take over the task of selling it since I was going through a lot of medical issues. Well, being the kind (and a little naive) person she is, she let a young couple with a two year old and a baby on the way move in. The family is Mexican and yes, they are illegal aliens. Anyway. The problem is that she let them move in on a two year lease with the option to buy after two years.

The mobile home is on a park's land. They had to fill out an application to the park. The man used one last name on the top and signed another name. He failed to supply a DL or SS#. He has no bank information and he checked off "no" where it asked if he had ever been evicted... which I found to be false. I also found a previous cocaine charge on his record where there WAS a DL listed. I have no idea if it is a fake DL or if he is not supplying it to us to avoid us finding out all of this.

Anyway. What should I do?

If he is paying rent and maintaining the property then I wouldn't worry about his immigration status, it isn't affecting you one way or the other. If he is destroyig the property or not paying rent, evict him. Knowing illegal immegrants (hello, aliens come from outerspace, not Mexico) personally, I know they can be very clean and quite people because they do not want to be deported. So I get a little testy when people want to kick them out of their rental properties because of their immigration status. Maybe the DL number he used is not his and it has a conviction on it he doesn't know about, these things happen when you are purchasing your identity for $50 when you cross the rio grand.

If you don't want them there, prove they lied on their lease and evict them, it costs a couple hundred dollars in civil court...otherwise leave them be.

Honestly, the best thing to do is two fold:
1) If you are 100% positive they are illegal, contact immigration services. They will handle it from there.
2) Contact an attorney: The lease they signed should be void since they used ficticious names. Also, an attorney would be able to give you the specific ins and outs for your state. If the information provided was not accurate, it should be grounds for terminating most rental agreements/leases.

i think a big issue is are they actually paying rent. If not, you could file (at least in NM)and evecition notice for non-payment of rent. Otherwise, I am not sure, other than call immigration and natrilization that, you can evict them because no laws (besides being illegal) have been broken.

in New Mexico there is a website that you can go to and find out if a person has ever been in the legal system (not juvies). this site is infor from statewide courts, from traffic court to criminal and civil, to divorces and probates. your state may have a similar site.

Don't take gifts from strangers. If you didn't expect this then yes your mother is a stranger, since you obviously didn't know she would do this, you don't know her as well as you thought you did. But seriously... Get yourself a lawyer! Most all lawyers will give you an hour of free time (free consultation). Unless you gave your mother Power of Attorney you have ground to stand on. Then your next visit is to the county sheriff be sure you ask the sheriff to ask them if they have been in contact with I.C.E (U.S. Immigration and Customs Enforcement). Remember, mobile homes depreciate in vale, now with these wetbacks in there you will lose value on it even quicker. This is not racist, it is a matter of fact. Good Luck

calling the ins would be a start. BUT BE CAREFUL. the "race card" might be played or aclu ((morons)) might be there to inform you that "you are not an American". send them an eviction notice. Tell everyone you meet.. MOSTLY the media. . .that they are ILLEGAL . this means they are BREAKING THE LAW.also ask them about LaRaza or 13 and see what their reaction is to those words.

Ask him if he has a GREEN CARD. If not let him know he falsified the rental agreement and you are going to turn him into immigration authorities.
They will be out in No time!!!

If they don't have a SS# then they don't have a DL. If they are illegal then call immigrations and have them deported.

I would explain to them all you know about them and then request they leave within x amount of time or you will be reporting them to ICE, and report to his place of employment that he is an illegal. (Would tell them anyhow that they are employing an illegal, and you will be reporting them, to ICE also) They'll be gone in 3 days.

first : the long path
do not buy any food or get any to your house
do not pay any bills , try to cut off electricity , then try to annoy them by every way , get some Friend of yours every day to spend time with you , bring 5 or more you can ,
second easy path:
say to them : get out of my house i can not stand more
third path:
call 911
