I've got a 2007 Chevy that went that turned out to be trash. Anyway, I found an attorney and gave him my case a few months ago back on June 24 and it took him until August 25 to get a first response/offer from GM which was crap. Basically they offered me less money than my attorney would get in fees and an extended warranty. My attorney agreed that it was crap, so he rejected the offer. The thing is, from June to Aug, he never spoke with me, I always speak to his assistant and when I asked to speak with the attorney, he only promisses me that he will call me back, and NEVER does. So I called on Aug. 25 and told them that if I don't get a call back from the attorney to find out what in the hell is going on, then I'm going to find another attroney. He then called me back and told me that he got an offer from GM.....what a coincidence, they day I threaten them going to a different attorney, he calls back and gives me this shitty offer, that even he told me not to accept. Back to The waiting game again. Since Aug 25, he hasn’t gotten back to me. Is there something wrong with my lawyer or is this lemon law process normal. What should I do?
Thanks!

I haven't paid my attorney anything. He told me that I wouldn't have to pay anything, and he would get his fees from GM.

The fact that the a legal process of this kind takes a lot of patience from both your lawyer and yourself, does not excuse him of not communicating properly with his client. As a lawyer he should know this. If he is too busy to call you back he should not be handling your case. I would recommend shopping around for another lawyer that can provide you the time you deserve. Maybe 50 lawyers at the bottom of the ocean is indeed a good start : )

No he cannot - that would be considered a conflict of interest which would ethically prevent another attorney (in the firm where you hired an attorney) from representing him. The theory is that once you have hired an attorney, another attorney in that firm could obtain information which you and your attorney deem privileged and use it it against you in the divorce proceedings. Although that "shouldn't" happen, that's what the ethical rule of conflict of interest is designed to prevent.

Here's the sentence that stuck out in my mind:

"Basically they offered me less money than my attorney would get in fees and an extended warranty. "

You said less than my attorney WOULD get....Does that mean you haven't paid him anything yet? Did he take your case on consignment? If so, especially with this kind of case, your attorney doesn't stand to make much money from this kind of litigation and thus, his disinterest/apathy about it...

I had a friend who bought a lemon too. The way she took care of it was to write some very unflattering grafitti about the car dealer all over the windows of the car and then she drove it all over town. Very bad publicity. She settled the matter with the car dealer very shortly after that, no attorney necessary!

Just a typical attorney. Don't be surprised if you get charged the attorneys hourly rate for talking to his assistant.

get a different lawyer. you're paying the lawyer to work for you and if he's not doing that... give him the boot.
