Where is it planted?

If the tree is planted on your property, it is yours to trim, and keep up. If it is on your neighbor's property it is his. You are well within your right to ask him to either help you trim it, or allow you to trim it how you see fit the portion over your fence. Either way, I see this as a co-operative effort. Work together to get what you both want.....

Both of the answers below are good. Talk with your neighbor first before proceeding. If the tree is on your property, it is your responsbility to prune the branches. Is your neighbor upset with the branches being over the fence? Communicate with him or her and either prune together or trim in the fall. HE has the CHOICE to cut off what hangs over.... or you can be nice and take it off if he asks... if YOU do the job, there's less chance of it being done wrong or at the wrong time and hurting the tree.... but you'll need his OK to go onto his property to do it....

Be sure to knock on their door and ask to go into their yard to cut the tree and dispose of the cuttings. :o)

It's your tree so you should be maintaining it so it doesn't get into the neighbors area. They should not have to maintain something you planted.
