I thought it was due on the 15th of the month...not the 1st of the month. I had no idea I was getting late fees. I think I have like 6 late fees...all for being about 2 days beyond the late grace period.

Sure they can, you signed the contract, they are on there.

Ignorance isn't always bliss.
They'll take the money you give them and apply it to the fees before they apply it to your new payment. SO it'll look like you're short paying your mortgage.
Your best bet is to call them and discuss it, maybe they'll reverse the fees. If not, just take those fees as a penalty for not being more aware.

If your contract imposes a late fee and you pay late, you must pay the fee.

Yes they can. You see you signed a legal and binding contract and if you have late fees, you have to pay them.

Read the promissory note. If it is in there, they can enforce.
