Since it was his tree that did the damage, he is to take the full responsibility for the damage, he MUST pay for any damage he has done, if not, take him to small claims court.

Time to talk to your solicitor. Even if the tree had blown down in a storm and smashed your property, he would be liable. In that case, insurance might cover it, but in the scenario you describe, best find out the facts from the law man.

He definitely is! How could anyone do that type of thing and then not feel responsible for it! He did it intentionally. It wasn't an act of god! Sue him if he wont pay for the damage! Take pictures first! Tree and all! Good Luck!

I take it the tree was his?.... or was it on your property?.... seems pretty silly to kill his own tree....that way.... besides, you need proof of him doing the bark and salt thing, so make sure you can save the part of the trunk where THAT happened!... tree sure did die fast... musta rotted faster than ever known to man!!!.... and for it to fall without a windstorm to push it over, too... wow.... did IT hit your awning or did YOUR pine tree hit your awning?.... ... tell ya what... this sounds fishy to me.... I think I'll just skip this one..............

He is responsible. But it make not be worth the trouble of making him take care of it. I'd defiantly speak to a lawyer about what steps you should take to make him pay for damages.

my neighbor's tree fell on my fence in a storm. my fence isn't made anymore. he had to replace it ALL (one acre of land in a subdivision).

I would have sprayed grass killer in his yard spelling out a.. hole,and then set the damn tree on fire in both yards.ain,t you glad you are not my neighbor.
