She shares with Harry the little information known about Ravenclaw's diadem (one of Voldemort's Horcruxes), and offers to escort Harry to the Ravenclaw common room to search for clues, but Ginny hurriedly suggests that Luna Lovegood take Harry up instead. Cho joins fellow D.A. members in the final battle against Voldemort and the Death Eaters.

Rowling isn't making a mistake here by having folks who have already left Hogwarts appear. For many who are either making a stand against Voldemort or whose blood status is likely to get them killed, Hogwarts becomes a safe haven.
And for many the realization that the final battle is going to be at Hogwarts draws them back to the school for that battle. This is especially true of those who were in Dumbledore's Army. So many of them still carry the coins Hermione cast the spell on to pass message's along as to when DA lessons were going to occur. Neville used the coins to recall DA members. And Cho was a DA member.

Cho came to Hogwarts only after she recieved Neville's message (through the coins). She wasn't already there.
Scrimegour threatens the trio saying that he could get them arrested for attacking the minister (himself), not for underage magic.

1. CHO is a member of the 'Dumbledore's Army' when she was in school . So she was having the fake Galleon with her which was used for sending messages.On Harry's return to Hogwarts, Neville sends message to members of Dumbledore's Army, Who come to join them in the war. Many others in D.A also came along with CHO.
Minister is not threatening , but , when Ron points his wand at the minister during their meeting, Harry asks Ron not to give a reason for the minister to arrest them.
It is not for using magic outside school.

because she was part of Dumbledore's Army and still got the message when Neville and peoples sent it through the coins. and about the scrimgeour matter, harry wasn't of age yet (i think). if he was it was probably about attack a minister. i can't remember. sorry.

Note that Hermione is almost a year old than Harry; I'd thought that Cho was in the same situation.

Sometimes mistakes happen. I myself was wondering, "Isn't modifying a memory a Memory Charm?" Because Hermione talks about modifying her parents memories in the beginning, but later says that "she's never done a Memory Charm before, but she knows the theory".
It could have been, too, that Cho had so much emotional stuff going on that she required an additional year to finish. Unlikely for a Ravenclaw, but it's a theory.
