i am so sorry for your loss. and no it is not fair, your mom can fight it. but if he was unable to do the job then they kinda have the right, but i personally would do everything to make sure my employees worked till they were ready to leave themselves. i would never think of putting more hardship on his family. it is sad how selfish people are in this world. more thought of money then doing good.

I'm sorry to hear that. They broke law question is can you prove it. See if ur mom can get an attorney to sue the company for the life insurance lost wages uncovered medical treatment because if he had med coverage thru them then they owe that too. Make sure that lawyer takes no or little up front and does it on contigency share of settlement

Also research company see what else they do wrong, When i was fired and wrongfully accused of theft i googled agency and found that they had fired a dr who worked for them after a heart attack and used that to help convince state to grant unemployment

You may get lucky and company will settle to avoid bad press or you may be angry enough to want to crush them either way good luck with it. Also be prepared for them to drag ur dad's name thru mud claiming he was fired for cause try and find ex or current employees that can counter that slander and maybe add it to suit

If he worked in an "At Will" state, the employer can fire a person for any reason. Not the answer you want to hear, but I think it was totally evil for them to do that.

Human Resources at this company really fell down of things. They should have at least helped him with COBRA paperwork and offered to extend his term life policy if they were the ones to offer it to him.
