My ex husband never took me off of our mortgage and then let the house go into foreclosure. He has been made to pay for my bankruptcy by the judge, but I still must go through the motions of bankruptcy and I'm very nervous about the hearing tomorrow as I've never done this before. For anyone who has been through bankruptcy, what should I expect at my hearing tomorrow?

Oh it is one of the easiest things to do. You basically go into the court room or whatever room they have assigned there for you- they usually will have several other people doing theirs at the same time. They make you sign in and you sit quietly and wait your turn. Each person can take anywhere between 5 minutes up to 15 minutes depending how lengthy theirs is. You can get up and walk outside if you know your turn isn't coming up for awhile. Then the judge will call you up and he swaers you in and you sit. He asks you questions that you answer with a yes or no and just be truthful. Your lawyer if you had one will be there to answers any legal issues. It is very simple. Then you go and get your papers in the mail maybe about 1-2 months after to say you have been dismissed. If yours is a simple bankruptcy then it should take like 5-10 minutes top.

I understand I was a nervous wreck and it turned out to be no big deal. We were there maybe an hour and ours was the very last one. So not too shabby. We were nervous over nothing. Our judge was a really funny guy too cracking jokes and all.

You will get a few minor questions but for the most part, let your lawyer do the talking. He should brief you before you go into the court. It is really not as bad as you would think. I don't think I said more than 20 words and was out in about 15 minutes. I had to wait for three hours before the 15 minutes which can make you nervous. Say as little as possible and just answer the questions they ask you honestly. You will be fine and let the lawyer earn their money.

It depends if you are filing for a Chapter 13 or Chapter 7

When I filed for Chapter 7 all I did was show up swear that I was me and I left...

Chapter 13 is where you pay a percentage of your debt... Not sure how that will work

In your case, be honest. If you have the documentation showing those were HIS assigned debts from the divorce, then the judge SHOULD wipe those debts out. Without that paperwork, you could be up the creek. Good luck.

you'll probably just confirm the debts, and they will sign you off on all those things... not 100% sure, they might make you pay for some of it
