Under California traffic laws that person can be charged (ticketed) for Littering and Throwing a burning object from his vehicle. Littering can produce a fine of up to $1,000 , 6 months in jail or both, throwing a burning object carries the same punishment except that if the object caused a fire to be started they can be found guilty of arson and have to pay the expenses associated with fighting the fire.

I think that most states have anti-littering laws and they probably have similar laws about throwing burning objects out of a vehicle. I do not know this to be true but it sounds reasonable that similar laws would exist.

Yes that's illegal everywhere. Careless smokers start median fires by the side of the highway fairly often, especially in the dry southwestern states, not to mention whole forest fires. In many states you can be cited for "Throwing a Burning Object From a Vehicle" by doing that, as well as littering. It's a smoker's responsibilty to have an ashtray in his car and use it. Many newer cars no longer come with ashtrays, but that's the owner's problem. You can either have the dealer install one as an optional accessory when you buy a new car, or buy an aftermarket ashtray from any auto parts store that fits right into your cupholder.

It is illegal in every state to throw cigarette butts out the window. This is the blame for most grass, field and other fires not to mention it litters the grounds. I am a smoker, so don't think that I am bashing smokers. I do distinguish my butts properly.

It is considered littering; however, it is very hard to enforce. Unless you throw it out with a cop sitting there then noone can prove you did it. Unless they do a DNA on it or something. Then that is a waste of taxpayer money. I would like to see more people keeping ashtrays in their cars though, so that the streets can be cleaner.

Yes, littering.
O.C.G.A. 16-7-40 et seq. and 16-7-50 et seq.
In Georgia, it is illegal to leave litter or dump waste on any public or private property, including highways, streets, alleys, parks, lawns, fields and forests.

It is considered littering in most places.

I issues citations for it here. Not only is it a fire hazard, I think it's extremely rude and lazy for someone to throw any trash onto the roadway.
