My husbands exwife is impossible!! She's been in jail, stays on drugs and she remarried and had 3 more children, so she has 5 in all.

The oldest child is my husbands and we know that thanks to a paternity test, but she won't give him a paternity test for the next to oldest child, which she claims is his, but has told him to his face that this child isn't his.

Here she is taking him back to court again....wanting MORE child support.

She doesn't do what the papers say, she lives off of welfare--medical card & foodstamps, etc. She's perfectly able to work, she just won't.

All she wants to do is get more & more child support money, she takes my husband back to court every chance she can trying to get more money.

We are a single income family with two children of our own.

Are there any ways to get child support lowered? To get a drug test on her & prove that she's not a good mother? Is there any way to do anything to get her to stop taking him back to court constantly?

We live in Kentucky and she moves around a lot, and we have no idea on the whereabouts of her at all.

There's gotta be something we can do.

My husband has ALWAYS paid his child support obligations. He has stepped up and been a father to the child that is not biolgoically his.

ok, to clear a few things up to a certain few that have gave an answer....the child is of age to decide which parent to live with. He has done that.....he has chosen his mother; furthermore he is afraid to speak against his mother-he is afraid of her.

File for a remodification hearing for child custody and support. Go for custody of the kids yourselfs. You can hve her ruled unfit as long as you can prove your allegations of her without using hearsay. This would be any medical or police reports. You can also file any support with the courts til she agrees with any paternal testing too. Unless the kids are beyond the age listed in the decree the support wont be lowered. The money she gets in support should be going back to the state for reimbursement of her welfare money

Well the courts know where she is or they couldn't send her the checks. My advice would be to get an attorney, tell him what you have stated here along with the dope charges. If he can have the child (your husbands) tested for drug residue. Then he stands a very good chance of not only getting custody and no support, but also a chance of making her pay him. Now don't get me wrong on this. I'm not stating that the child him/herself is doing drugs. It's just that if say the mother is a smoker of pot around the child, then it should show up in the test and is therefore considered abuse. Either way that you should decide to go, I would say to get an attorney well in advance to help you. Good luck to you.

What you need to do is get a lawyer to help you fight the battle. It wont be hard to prove she gets around with all the children she has. Show a concern that your not sure how many kids your Husband has Fathered with her and have the lawyer ask the Judge of a paternity test before you are asked to pay more child support. You may have a good chance in proving her unfit to care for her kids with her criminal background. If so your Husband may be able to get custody of the kids he Fathered and she might be paying your Husband child support. Some people live of welfare because if you have to many children they know they can get free money to set at home on there asses. Take my ex for example.....We got a divorce in 1993 ( I paid for it ). He lost his job shortly after. He moved in with his Mom and Dad. His Mom died a few years later and he spent four years morning and living off his Dad. It is 2007 and he has never went back to work. He hurt himself two years ago and now lives off disability and the SRS is now having his hospital bills wrote off because he has no job and I'm paying for him to go back to school at age 45 ( through my taxes). And to top that all of his Dad (my Sons Grandpa) pays me my child support. Trust me I know how you feel. Good luck to your Family. Lets hope she gets what she deserves.

So to prove she is an unfit mother means you get his children? You can have a paternity test for each child that you pay child support on. I would be worrying about the welfare of the children that are supposed to be your husbands, they can't be taken care of moving around all the time. So sad isn't it? so you and your husband allows his child to be in the presence of such a horrible person? if you dont want to pay CS, then sue her for custody and take the kid away from her and make her pay CS to him. sounds like he would have no problem getting the kid if she is such a jailbird drugged out loser. otherwise, she is within her rights to sue for CS,. It may not be right in your eyes, but it is still legal. Next time you go to court, be sure the judge knows that you doubt the paternity of the second and that you want a test, the judge can force her to submit the child for DNA testing.

He needs to petition the court and bring in supporting documentation, and he needs to make sure that that child is his he needs to petition the court to make her get a paternity test, and he needs to sue for custody no child should be subjected to that crap and if he lets it go on then he is a sorry excuse of a man. Girl, you and your husband needs a attorney!

Well for starters talk to an attorney and get the paperwork going to testing on the child to see if he is his. Until further notice his support might be held in escrow until it is proven to be his or not. If it is not his the money will be returned to him.
You need to talk to a social worker about the ex. She is not a responsible parent and needs to be accountable for her actions.
You request to have child support lowered. You have to go the agency in area and get papers to request it.

talk to a lawyer or go to the local department of social services and see what they can do.... make the child take a paternity test and you can also ask for a drug test good luck

you need to get a lawyer tell him all that is going on and by law she has to have a test done to prove that the child is his. dont let her run over you like that. besure and let the lawyer and courts know all that is going on with the drugs moving around living on all the goverment help. fight back.
