She works full-time 8 hrs. She has 1 break for 15 min. and 1 lunch for 30 hr. her team leader ( not her manager) told her that if she doesn't like it she will not schedule her in the high traffic area where she opens ALOT of credit cards and she would be placed in a low traffic area in a very slow part of the store. Can she file a harassment complaint against Sears?
I just find it strange that her team leader would make her work 7 hours straight with one 15 min break. My wife came home depressed with a stomache ache at night and couldn't sleep because she was trying to figure out why this was happening to her.

Sears has a phone number she call call and report unethical activity. It is designed to protect against theft but also so that all employees nationwide are treated equally. She will talk to a HR specialist in Hoffman Estates, IL. The call will be confidential. HR will re-inform that stores managers of Sears policy that is being misused.

It's been a while for me, but I think she cannot even take a break until after 21/2 hours and a lunch must be taken before 51/2 hours.

Team Leaders are " COMPANY PEOPLE " , not Union people.....they are there for the betterment of the company, not to be a buddy with a shoulder to cry on. I certainly would file a complaint with the labor board, and you CAN do that , since your wife is not working under a union. Remember, Sears is now owned by K-mart, who , I am told, is still under bankruptcy proceedings.

I believe Federal guide lines state that you must take a lunch break between 3-5hours from the beginning of your shift if you work a minimum of 6 hours. I would contact the labor board of your state if it continues. We need to stand up for what is right and wrong.

i would certainly talk with the MANAGER, not the team leader. I agree, going 7 hours without a proper break will without a doubt make a person miserable.

ACcording to federal law, employers have to allow breaks and a lunch. Your wife should go directly to the manager!

There's laws about resting over a certain period of time worked you should find out and then claim it for your wife.

Quietly organize. Contact a union.

It's difficult, but not impossible to form a union these days.
