I am aware of no order by Clinton to bypass FISA courts. It is unknown whether the spying involved Americans calling Americans because of the stonewalling by Gonzales and others. From the limited answers given by Gonzales and his ignorance of the Constitution (or just plain mis-use and mis-interpretation) it is apparent that the Admin. may have done ANYTHING they deemed required...including breaking laws and listening in on anyone, including political adversaries.

Who cares?

Clinton's gone and I don't know anyone who would have wanted him in charge when 9/11 happened.

His real legacy will eventually be the selling of missile technology to China - which of course found it's way to North Korea.

The so called warrant-less wiretaps were named to make Americans think the government was spying on them without oversight.

For the last time, there is no "spying on Americans without fisa approval."

The program concerned CROSS BORDER CALLS INTO OR FROM THE US. NSA targets specific foreigners with ties to terror groups. It needs and obtains no warrant to do this. When those foreign terror suspects call into the US or receive a call from the US - - - or e-mail, IM, text, etc... - - - they don't 'stop listening.'

That's not "spying on Americans," it's not "domestic spying," it's not "domestic surveillance."

What is IS is specifically excluded from application of FISA, by the definitions section in the FISA statute.

You can agree with the program or not agree with the program - that's your opinion. I agree with it but I can see how a rational, civil-liberties-minded person might disagree with it. But whether it's "domestic" is not a matter of opinion, it's a matter of fact. And whether it's legal is not a matter of opinion either.

Voting "thumbs down" is pretty childish too - - facts are facts, libs, you don't get to change them by voting thumbs down - stop being such a bunch of babies.

Clinton wouldn't need to write the EO unless he wanted to do no warrant searches. EO are used for special things.

Also, FISA has been used to catch Americans accused of terrorist activities.

Clinton's EO: "the Attorney General is authorized to approve physical searches, without a court order".

That means without the approval of FISA.

People need to realize that America is at war with terrorists. They wear no uniforms and they may live near you. It requires extraordinary efforts to catch them and to get them to release information vital to stopping terrorist attacks.

FISA was used to catch Padilla who is an American.
