Our fence got torn apart by strong winds about 6 months ago. We ask our neighbors to help pay so we can get the fence fixed, but they refuse. What can we do about it? Isn't it invasion of privacy since they can see what we're doing vise versa?

It's a shared fence.

first of all there is no law saying you have to have a fence between you and your neighbor so the invasion of privacy thing is out....secondly, was it your fence or theirs to start with, and whose side of the property line was it on?....if it was your fence then your responsible, if it was theirs thats on them, if they dont want to fix it then there will be no fence until you fork out the cash to put up your own.

There is not much you can do actually. Although a considerate neighbor would help, they are not obliged to, unless of course they just tore down the fence.

Pay for it and MAKE SURE it is not encroaching on their property.

You could probably file a claim for unjust enrichment. (ie. they are getting the benefit of the fence without contribution) but the likelihood of being sucessful in such a claim would be slim and the process is time and money consuming.

If it is a shared fence, you are equally responsible. Try suing them in small claims for their half.
I have a similar situation: I blatantly and without apology HATE my neighbor so badly, I will never talk to him, so I will just fix the fence myself so I won't have to deal with him, and it will be double reinforced so his damn dogs can never break through again.

Your fence or there's? depending on where you live they do not have to let you work from there side.
this is why 1 should never put the fence rite on the property line. like my mother use to do. lol.
call your call your sheriff or local police they'll know more about this. i'm sure it'll not be a first.

It depends on whose property the fence is on. There is a propert line somewhere. The fence shouldn't lie directly on it. Who drew the permit and installed it? If it is yours you are responsible for it 100%.

Who originally built the fence?

If they refuse to contribute to the fence repair they have no right to refuse you going on their property to repair and maintain the fence! If they do take them to court and demand payment because they refused to permit work to be done on it and demand legal fees involved with the court case!

Have a letter written to them from an Attorney on your behalf. Try the site below and watch the presentation. This will help.
