There are too reasons you could get in trouble. The first is by claiming the goods are authentic. That is fraud against the buyer. You can avoid that charge buy CLEARLY stating in the auction that you are selling fakes. The second applies if what you are faking is protected under a trademark, etc. If you sell fake brand name merchandise, the owner of the brand can sue.

No, as long as you do not say that it's the authentic. If you do though, not only could you get in trouble with eBay, but you could get into legal trouble with the buyer or just in general with the law for being a distributor of fake bags.

honest answer is no, ebay will only remove the fake IF the owner (company) of the original item puts in an official vero complaint against your individual listing. I am a vero member and still have to individually report every single fake copy of my work. this takes up hours of my working week...every week. As soon as the item is removed someone else lists another fake for sale and on it goes.
The sellers often clearly state that the item they are selling is a copy !!, ebay is not interested, they don't read the listings, the copyright owner still has to hunt out the fakes themselves and report them. the seller does not loose their ebay account and no further action is taken.
One large company Jaeger, took ebay to court and now when listing a Jaeger item ebay has to ask the seller if the item is genuine. But it cost jaeger a fortune in court costs.

If you are selling counterfeit items, yes, you can go to jail.
However, there are something like 20,000 Elvis impersonators working in the US. Those fake Elvises are legal.
If you're honest with your customer, and label your fakes as fakes, they will generally be considered legal knockoffs, rather than counterfeits. This is going to work better if you are selling in ones, rather than in dozens or grosses. When you sell in large quantities, you could be prosecuted as accessory to the crime if your customer tries to pass off the goods as real, not fakes.

if you are selling fakes and don't tell the buyer, you are committing a fraud which could get you into serious trouble with the law. if you tell the buyer its a fake the real owner could find out then you could get into serious trouble with the law. either way sounds like a bad idea.

you will only get your account suspended from ebay unless you are telling your buyers that your merchandise is original they might put a police report on you and thats how you can get in trouble with the authorities.

If you advertise the goods as authentic when in fact the are counterfeits you would be guilty of consumer fraud. If caught, you will never be able to pay off the fine and/or your prison record will follow as long as you live.

umm...what do you mean "fake" hats, shirts, etc? like knock off brand dolche and gabbana or something? i think that as long as youre like "this is fake" you wont get in trouble. but who would buy that?
