that depends on the laws in your state.. For some it is when the marriage has been consummated. Reasons for annulment can be,; a fraud in marriage, lied about age, discovered already married to someone else, ( usually is null when finds out ) one or both was under the influence of drugs or alcohol, either was mentally not capable, concealment of facts; being a drug user,prior criminal record, or having a sexually transmitted disease, Laws preventing by blood relationship ex; 2nd cousins etc to marry, or 1st cousins.. and other factors to name a few.. You really need to contact an attorney to ask in your state.. some are 1 yr, others 3yrs from discovery of fraud if so in relationship. Attorney's often will do a first free interview.or you can ask to speak to their paralegal. So sorry to hear you feel the need for such..

I thought it was never too late, if one of the parties was incapable of consent, but I have a feeling that the answer differs depending on the state you're in. Catholic marriages have been annulled by the Church even after years and when children had been born within the marriage.
Is there a lawyer in the house?

For MissieJ, the word is consumated, not consecrated. If you have not had sex with him after the marriage. Check with the immigration service (of all people) and your local courts. There should be no reason you could not get this annulled since you were married under false pretences. If there is a problem with annullment, then just get a divorce. It is a little more hassle but just as final. And with him out of the country, you could put anything you wanted in the paperwork like alimony and support. Then if he ever gets his visa and returns, you get a pile of money for your aggrevation of divorce instead of annullment.

You have to show the court that the marriage was never legally valid in the first place. Don't know if there'd be a time limit.

usually after intercourse has occured unless you can proove you were not in a sobre state of mind and did not know what you were doing or if one of you refuses to have intercourse or refuses to have kids depending on the religion asnd the law.
