My boyfriends family picks his child up from school everyday, he then takes him home to feed and bathe him when he finishes work. He then drops him off to the mum. Between him and his family they pay for the food and clothes. And she is now asking for csa because ive moved in. We can just about to afford to likve now let alone having another outgoing.

Where do we stand?

Hi there as the child lives with the mother .. IE she has parental responsibility she can demand csa for the child ...

The csa will take into account both your wages and housing costs ....

My husband pays an awful lot to his ex wife for csa .. but the child still needs supporting financially and that is down to the dad

If she is the parent with care then the simple answer is that 15% of his money after tax, ni and pension will be given to the mother. It doesn't matter how much you spend on food, clothes it simply does not count towards the figure. The strict letter of the law is 15% of his wage will go to the mother. There is only one area were you can legally reduce your payments and that is if the child stays with you more than 52 nights a year, then you get 1/7 reduction, or if you can get more time then further reductions apply.
The best approach is to try and come to some arrangement with the mother. However if the mother now recieves income support then the CSA become involved automatically.

Not good. Their best bet would be to work out a detailed plan outside of the courtroom that would be beneficial to all. If they let the courts decide Ill guarantee your boyfriend will get screwed in the long run and the present status quo will change drastically whether its your fault or not, so he needs to work this out with her and be willing to compromise because he really doesnt want this to end up being decided in court. The Judge will usually okay a worked out planned if signed by both parties agreeable to all. Good luck

go for joint custody with care and control going to your bf; point out that his family spend more time with the child than the mother does.
