We recently purchased a brand new condo about a month ago. For our condo we have a 1 car garage and 1 assigned outside parking spot. The parking spot has our condo number on it and the words "reserved" right below that.

The problem is 3-4 nights a week someone parks in our spot. Sometimes there are un-marked spots we can then park in... but sometimes there are not and we're forced to park in the red fire zone area.

I've called our local police department and they said unfortunately there's nothing they can do.

I've called the tow company the police department uses and they said they can't tow the car because it's private property and there's no sign that says "Vehicle may be towed at owners expense."

We've been leaving notes on cars nicely asking them not to park in our spot... but some people just don't care and continue to park there.

What options do we have? What can we do? We own that parking spot and people are using our property without our permision.

From a resident/president of a condo assn.
-A local tow company will require the assn to sign a contract thus your condo fees will likely go up.
-Our by-laws have stated that visitors will park in the assigned parking spots for visitors.
-If the above does not work then a letter goes out to the tenant/owner of the unit that is being visited by the offender and gives a warning that they will be subject to a fine. This action puts the onus on the owner to tell guests to park elsewhere or they will be fined, this is also in our by-laws.
-If you have a big enough assn then maybe your best option would be to hire a tow company. A tow company can be hired by your condo assn council.
- One last thought, submit enough complaint letters to the council and eventually some action will be taken.
I hope this helps a little our assn has gone thru the same thing.

Since it's private property, the police probably can't do anything. You can do one of two things:

1. if your building has some type of association, bring it up at the meeting. Ask the board to fund some sort of enforcement program

2. ask the managing owner or company to put up a sign saying "vehicle may be towed...." and then see if the company is willing to tow. Also call a few other companies.

Don't you have a condo board? They should be able to do something. That may also be BS that the police can't do anything. Its your property. I'd go down and speak to the commanding officer. If they don't do anything, try blocking them in. Leave a note with you apt number and make them come ask you to move, then take your sweet time. I'm sure if they also discovered that parking in your spot mysteriously led to flat tires may also cause them to stop. Take their plates off the car. Then call the police and say its a stolen car. Maybe then they will remove it!

It sounds like you have done everything currently possible. You need to get the condo association to authorize the posting of signs which threaten "Vehicle may be towed at owner's expense", and then you can have the offending vehicle(s) forcibly removed. However, even such "legal" action can have unintended adverse consequences (i.e. retaliation vandalism).

I am surprised the towing company didn't cooperate. Is there a Homeowners Association? If so, tell them to put the sign on. Or put the sign on yourself and then have them towed/

Stick your own sign in the ground that states "vehicles will be towed at owner's expense."

Doesn't your association have a rule to deal with this? It better.

You put the burden on THEM to enforce it.
