I used to live in Chicago but have moved to Las Vegas. While in Chicago I worked as an assistant manager at a hardware store. In May as I was leaving the store one day I got into a verbal scuffle with another assistant manager. As he was storming back into the store he said to me "why don't you go F_ _ _ yourself". I was off duty he was still on duty. I was just going to let it go but some people have told me that I should sue them. The only thing they did to him was yelled at him he wasn't even suspended or anything. Has my statute of limitations run out or do I still have time? Also does it matter that I have moved? This has really been hard on me. I have looked for work out here and the thought of getting back into retail has given me panic attacks and I cry about it almost every day. What should I do?

I don't think that statutes of limitations will be an issue if it just happened three months ago. Obviously, any lawsuit would have to be filed in Illinois.

The biggest problem is not the statute of limitations but that I do not see any available lawsuit. While I don't practice law in Illinois (and if you think you have a claim feel free to talk to a lawyer who does), all that you have described is that your former manager was obnoxious and rude. I don't know of any state that has a claim for damages for that reason.

What type of cause of action are you contemplating?

Doesn't sound like you were fired or were forced to quit, so it is not a wrongful discharge case.

Doesn't sound like the assistant manager struck you or made any physical contact with you, so it is not a battery (assault) case.

Getting yelled at is uncomfortable (particularly if the offending party is using profane or threatening language), but it often does not give rise to any type of tort action.

(By the way, the usual tort statute of limitations is about two or three years from the date of the incident. The actual period will depend on what type of tort suit you are bringing.)

The statute of limitations hasn't run out, but it doesn't sound like you had much of a case to begin with.

IF YOU WERE OFF DUTY THEN THEY REPRIMANDED HIM AS THEY DID--IF YOU WERE ON DUTY THEN THEY COULD HAVE CHARGED HIM WITH CONDUCT UNBECOMMING A SUPERIOR, CREATING A HOSTILE WORKING ENVIORNMENT ETC--IN THE DOG EAT DOG WORLD, EVERYDAY IS A CHALLENGE TO COMPETE IF YOU ARE NOT COMPETITIVE-BECOME A GREETER AT WALL MART OR SAMS CLUB OR ACADEMY OR WORK AS A DOOR MAN AT A HOTEL OR A LUGGAGE BOY--GOOD LUCK IN YOUR ENDEVOURS
