If you are a merchant in the state of missouri is it against the law to do the following:

Post a list forpublic view of names of people with returned checks NSF

Tell friends and family of a person that they have bad checks at your store

soliciate money from a persons mom


what if you took the check (s) from a young mans girlfriend and watched her sign his name without him present?

can legal action be taken on either side for those issues

Yes it is illegal for a mercahant to to post the list into the public eye. Even though you know this happens with certain individuals, it still can be slander, defamation of character, and wrongful advertisiong so to speak. You can have the list, but have a check of theirs marked NSF, this can be a mistake on some individuals part, but on those that constantly do it, you know it's not. To have the proof, and "WORD OF MOUTH", that's not putting it in the public eye. So what if you were telling someone about it and others over heard.
What you could do with the family is friends is say something to the effect like "hey when you see so and so, tell them to come see me, I got a check back that I need taken care of". Before you "blad" i'd make an attempt to let the individual know such as send a registered letter to the residence and make sure you get a reciept back. After that attempt fails, then go the route to friends and family. Don't soliciate from the persons family, it's not their responsibility to pay you and this can be taken as harassment because it's not their debt. Taking a check from a person that isn't on the account is and watching them sign a name different than their own is not a good thing. You as well as them can be accountable for fraud,and forgery. Even though you didn't sign the name, it's still a crime against you because you knew about it. I don't know about the state you are in, but in some states, that can be considered embezzlement. Yes, sorry to tell you, legal action can be taken against you in some of these instances. My advice to you is seek legal counsel, remember, this world is all about C.Y.O.A ( cover your own a**)

Well forging checks is certainly illegal.

It's called uttering a publishing. Go to http://www.findlaw.com/casecode/#statelaw , select your state, and search for uttering and publishing, or just uttering.
